These Terms & Conditions apply to your use of Big Chicken products, programmes, courses, resources and services.

Big Chicken is a brand operated by Confident Rider Ltd, a New Zealand company.

By purchasing, registering for or accessing a Big Chicken product, programme or service, you agree to these Terms & Conditions.

PURCHASES & PAYMENT

Prices and payment terms are displayed at the time of purchase.

Payments may be processed by third-party payment providers such as Stripe. By making a purchase, you agree to provide accurate and complete payment information and authorise the applicable charges.

Where a payment plan is offered, you are agreeing to make all payments in that plan unless the specific offer terms state otherwise.

If a payment fails, we may temporarily suspend access to the relevant product or programme while payment is outstanding.

ACCESS TO DIGITAL PRODUCTS & PROGRAMMES

Big Chicken products may include digital resources, courses, audio, video, live sessions, challenges, programmes, downloads or other materials.

Some products are delivered through MemberVault or other third-party platforms.

The length of access will be stated on the relevant sales or checkout page. Where no specific access period is stated, we will provide access for a reasonable period while the product remains actively supported by Big Chicken.

We may occasionally update, reorganise or replace content or delivery platforms. Where reasonably possible, we'll avoid making changes that materially reduce something you've already purchased.

LIVE PROGRAMMES & EVENTS

Some Big Chicken programmes include live sessions, workshops, Q&As, co-working sessions or other scheduled events.

Dates and times may occasionally need to change. If this happens, we'll make reasonable efforts to let participants know and, where appropriate, provide an alternative or recording.

Unless specifically promised as part of an offer, attendance at a particular live session is not guaranteed.

REFUNDS & CANCELLATIONS

The refund or cancellation terms that apply to a particular product or programme will be shown on the relevant sales or checkout page.

Because some Big Chicken products provide immediate access to digital content, refunds may not be available simply because you change your mind after gaining access, except where required by law or where the specific offer includes a refund policy.

Nothing in these Terms limits any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable consumer law where those laws apply.

INTELLECTUAL PROPERTY

Unless otherwise stated, Big Chicken content and materials are owned by or licensed to Confident Rider Ltd and are protected by applicable intellectual property laws.

When you purchase a Big Chicken product, you're purchasing access to and permission to use the material for your own personal use. You aren't purchasing ownership of the material itself.

You may not reproduce, distribute, sell, share, publish, upload, teach from or create commercial products from Big Chicken materials without our written permission.

Please don't share your MemberVault login or paid materials with people who haven't purchased access.

YOUR WORK REMAINS YOURS

Anything you create through participating in a Big Chicken programme remains yours.

We don't claim ownership of your ideas, writing, artwork, business concepts, projects or other original work simply because you created or discussed them while participating in Big Chicken.

COMMUNITY & PARTICIPATION

Where a Big Chicken product includes a community, group discussion, live session or other participant interaction, we ask everyone to behave in a way that allows other people to participate safely and constructively.

We may remove content or restrict or terminate someone's participation where behaviour is abusive, discriminatory, threatening, deliberately disruptive or seriously infringes another person's rights or privacy.

Where reasonably appropriate, we'll attempt to address an issue before removing access.

PRIVACY & CONFIDENTIALITY

Please respect the privacy of other participants.

Information, stories, projects or personal experiences shared by other participants in a private Big Chicken space should not be copied, recorded or shared outside that space without their permission.

Our handling of personal information is explained in the Big Chicken Privacy Policy.

RECORDINGS

Some live Big Chicken sessions may be recorded and made available to participants.

We'll let you know where a session is being recorded. Depending on how you participate, your name, voice, image, chat messages or contributions may appear in a recording.

If you'd prefer not to appear in a recording, you can keep your camera and microphone off and avoid contributing identifying information to recorded portions of the session.

Where practical, particularly personal discussions may be excluded from recordings.

EDUCATIONAL PURPOSES

Big Chicken provides educational information, tools, frameworks and support.

Our content may discuss creativity, behaviour, business, motivation, neuroscience, psychology and nervous-system awareness, but it isn't a substitute for individual medical, psychological, therapeutic, legal, financial or other professional advice.

RESULTS

We'd very much like you to do the thing.

Unfortunately, we cannot contractually guarantee that you will do the thing.

Results vary depending on the person, project, circumstances and countless factors outside our control. Purchasing or participating in a Big Chicken product or programme doesn't guarantee a particular creative, personal, business or financial outcome.

THIRD-PARTY SERVICES

Big Chicken uses third-party platforms and services to operate and deliver its products.

We aren't responsible for outages, changes or interruptions caused by third-party services outside our reasonable control, although we'll make reasonable efforts to help restore or provide alternative access where appropriate.

AVAILABILITY & CHANGES

We may update, change or discontinue Big Chicken products, features or services from time to time.

If a significant change affects something you've already paid for, we'll take reasonable steps to provide the purchased service, an appropriate alternative or another remedy where required by law.

LIMITATION OF LIABILITY

To the extent permitted by law, Confident Rider Ltd isn't liable for indirect or consequential loss arising from your use of Big Chicken products, services or information.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, or limits rights you have under applicable consumer protection legislation.

TERMINATION OF ACCESS

We may suspend or terminate access where someone materially breaches these Terms, including by sharing paid content without permission, failing to make agreed payments or seriously disrupting a Big Chicken community or programme.

Where appropriate, we'll give you an opportunity to remedy the issue first.

NEW ZEALAND LAW

These Terms are governed by the laws of New Zealand.

Nothing in these Terms is intended to prevent a consumer from exercising rights they have under applicable consumer protection law.

CHANGES TO THESE TERMS

Big Chicken is still growing its feathers, so our products and services will inevitably evolve.

We may update these Terms from time to time. The current version will be published on the Big Chicken website with the date it was last updated.

Changes won't retrospectively remove rights you've already acquired under an existing purchase.
